Our guided vehicle photography application, LotPix is designed to capture and process images of vehicles for purposes including inventory management, marketing, listing optimization, and performance analytics.
While the primary subject of collected images is vehicles, photographs may incidentally capture individuals, facial features, or other elements that could be considered biometric identifiers or biometric information under applicable law.
To the extent biometric identifiers or biometric information are collected, generated, or inferred from images, we will comply with all applicable biometric privacy laws and will:
- Limit Collection: Avoid intentionally collecting biometric identifiers unless necessary for a disclosed and permitted purpose
- Obtain Consent Where Required: Obtain prior written consent before collecting or processing biometric identifiers where required by law
- Purpose Limitation: Use such data solely for legitimate business purposes, such as quality assurance, fraud prevention, or image processing functionality
- No Sale or Unauthorized Disclosure: Not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information
- Retention Limits: Retain biometric data only for as long as necessary to fulfill the disclosed purpose, or as required by law
- Secure Storage: Implement reasonable administrative, technical, and physical safeguards to protect biometric data
- Deletion Protocols: Permanently delete biometric identifiers when the initial purpose for collection has been satisfied or within legally required timeframes
Individuals whose biometric information may have been collected may exercise applicable privacy rights, including rights to access, deletion, and information regarding our data practices, by contacting us using the information provided in this Privacy Policy.
We do not use facial recognition or biometric identification technologies to identify individuals.
1. Purpose
This policy is adopted to comply with the Illinois Biometric Information Privacy Act.
2. Definitions
Biometric Identifier includes facial geometry or other unique biological characteristics
Biometric Information means data derived from biometric identifiers
3. Collection and Use
We do not intentionally collect biometric identifiers. However, images captured through our vehicle photography application may incidentally include biometric data.
If biometric data is collected:
- It is used only for limited internal purposes
- It is not used for identification or recognition
4. Written Consent
Where required, we will obtain prior written consent before collecting biometric identifiers.
5. Retention Schedule
Biometric data will be retained only until:
- The initial purpose has been satisfied, OR
- Within 3 years of last interaction, whichever occurs first
After that, it will be permanently deleted.
6. Disclosure
We do NOT:
- Sell biometric data
- Lease or trade biometric data
We only disclose if:
- Required by law
- Necessary to provide services
7. Safeguards
We use reasonable security measures to protect biometric data.
