TCPA Compliance & SMS Terms and Conditions
1. Overview
This TCPA Consent & SMS Communications Disclosure (“Notice”) explains how Metzger Enterprises LLC d/b/a AutoRevolution (“we,” “our,” or “us”), collects and uses your phone number for communications, including marketing and informational messages, in compliance with the Telephone Consumer Protection Act, applicable Federal Communications Commission regulations, and applicable state telemarketing laws.
By providing your phone number through our website, forms, applications, or services, you agree to the terms described in this Notice.
2. Prior Express Written Consent
By providing your phone number and affirmatively consenting through a clear and conspicuous, standalone checkbox, you agree to receive recurring calls and text messages from Metzger Enterprises LLC dba AutoRevolution.
These communications may be sent using automated technology, including systems that may use automated dialing, prerecorded or artificial voice messages, or similar technologies, including equipment that may qualify as an automatic telephone dialing system under applicable law.
Types of messages may include:
- Marketing and promotional communications
- Appointment reminders
- Service notifications and updates
- Account-related alerts
- Customer support responses
IMPORTANT:
- Consent is not a condition of purchase.
- We may rely on available reassigned number databases and industry tools to identify number changes and will promptly cease messaging upon indication that a number has been reassigned.
- Your consent applies only to AutoRevolution. No other company is authorized to contact you using this consent. If you are referred to a third party, you will be presented with a separate disclosure and asked to provide separate consent where required by law.
- You represent that you are the authorized subscriber or customary user of the phone number provided.
- Each message will clearly identify AutoRevolution as the sender.
- We comply with applicable telemarketing and consumer protection laws in all applicable jurisdictions, including but not limited to Florida, Texas, California, Oklahoma, New York, New Jersey, Pennsylvania, Colorado, and Washington.
- Messages will be sent only between permitted hours under applicable law (generally 8 a.m. to 9 p.m. local time in accordance with federal and applicable state law time restrictions).
- Messaging campaigns comply with applicable industry guidelines, including carrier and messaging platform requirements.
- Marketing messages require prior express written consent. Informational or transactional messages may be sent where permitted by law and based on your interaction with us.
3. State‑Specific Disclosures
3.1 Florida
Consent includes messages sent using an automated system for the selection or dialing of telephone numbers under the Florida Telephone Solicitation Act. You retain rights under applicable state telemarketing laws.
3.2 Oklahoma
Oklahoma’s mini‑TCPA definitions of prior express written consent apply where applicable, including required disclosures for automated systems.
3.3 Texas
Communications comply with the Texas Business & Commerce Code and related telemarketing and consumer protection provisions, including prohibitions on deceptive practices.
3.4 California

3.5 Washington
Washington’s telemarketing laws require clear disclosure of automated technology and opt‑out mechanisms. Consent is required before initiating autodialed messages.
3.6 New York
Under New York telemarketing regulations, consent for autodialed calls and texts must be documented and maintained, and marketing communications are subject to strict timing and identification requirements.
3.7 New Jersey
New Jersey telemarketing law requires affirmative consent for autodialed calls or texts and compliance with state privacy protections. AutoRevolution monitors and complies with these statutory requirements.
3.8 Pennsylvania
Pennsylvania’s telemarketing statutes and UCCC provisions require that consent be obtained before initiating automated messages. AutoRevolution adheres to these requirements and to applicable caller identification rules.
3.9 Colorado
Colorado’s Consumer Protection Act (CPA) and Uniform Consumer Credit Code (UCCC) may apply where communications involve credit, financing, or related solicitations. You have the right to limit or rescind marketing consent under Colorado law, subject to compliance with this disclosure.
3. Form level Consent Requirement
Consent must be obtained through a standalone, unchecked checkbox that is not bundled with other agreements. The disclosure is presented in a clear and conspicuous manner, immediately adjacent to the consent mechanism, without requiring the user to navigate away from the form.
The disclosure and consent checkbox must:
- Be clearly visible without scrolling where reasonably possible
- Use a font size and contrast consistent with surrounding text
- Include a direct hyperlink to this Notice and Privacy Policy
- Not be obscured, pre-checked, or bundled with other terms
By checking this box and clicking ‘Submit,’ you agree to receive recurring marketing and informational calls and text messages (including SMS and MMS) from Metzger Enterprises LLC d/b/a AutoRevolution at the phone number provided, including using automated technology, which may include automatic dialing systems, artificial or prerecorded voice messages, or other messaging technologies. 4. No Third-Party Marketing Without Separate Consent
Your consent does NOT authorize unrelated third parties to contact you.
If you are connected with a dealership or service provider through your request:
- That entity will be clearly identified at the time of consent, and
- Any communications from that entity require separate consent where required by law
We do not sell, rent, or share consent with third parties for their independent marketing.

Message frequency varies and is based on your interactions with us (typically up to 5 per week)

7. Opt-Out and Revocation of Consent
You may revoke consent at any time, and we will honor all opt-out requests submitted through any reasonable means, even if not using a standard keyword, including:

- Replying with other clear opt-out requests (e.g., “unsubscribe,” “cancel”)

- No further messages will be sent using automated technology, except where for a one-time confirmation message or messages necessary to complete an ongoing transaction initiated by you. (e.g., transactional messages)
- Opt-out requests are processed as soon as reasonably practicable, typically within 24 hours, and no later than 10 business days, and in accordance with applicable law.
- Revocation of consent applies only to the phone number provided and does not affect other contact methods.

9. Double Opt-In (Confirmation Process)
We may require a double opt-in for certain campaigns, including marketing campaigns where required by law or carrier policies, including:
- Sending a confirmation message after initial opt-in;
- Requiring user action (e.g., reply YES) to confirm enrollment.
This process helps ensure valid consent and prevent unauthorized enrollment.
10. Do Not Call Rights
You may register your phone number on the National Do Not Call Registry and applicable state DNC lists. AutoRevolution honors all DNC requirements consistent with applicable telemarketing and privacy laws. Where legally valid prior express written consent is obtained, certain communications may still be permissible under federal and state law.
11. Eligibility
You must be:
- You must be at least 18 years old to provide consent.
We do not knowingly send marketing messages to minors. If we learn a number is associated with a minor, we will promptly remove it from marketing communications.
12. Record of Consent
We maintain records of:
- Consent timestamp
- IP address and session data
- Exact disclosure presented at time of consent
- Method of consent (web form, checkbox, etc.)
These records are retained to demonstrate compliance, including clickstream data and user interaction records demonstrating affirmative assent.
13. Use of Service Providers
We use service providers (e.g., messaging platforms, CRM systems) to send communications on our behalf.
These providers:
- Act only on our instructions
- Are contractually prohibited from using your data for their own marketing
- Must comply with applicable laws
14. AI-Assisted Communications
We may use automated tools to assist in message delivery and timing.
We may use automated or AI-assisted tools to help generate or deliver messages in accordance with your consent. These tools operate under our control and do not independently make contact decisions. Where required by law, we will disclose when messages are generated or materially assisted by automated systems. All messages are initiated and controlled by Metzger Enterprises LLC d/b/a AutoRevolution, even where automated or AI-assisted tools are used.
15. Carrier Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Messaging services are subject to carrier approval and compliance with A2P 10DLC requirements. Message content will be consistent with the purpose described at the time of consent.
